Two NYC fashion photographers are now suing their Manhattan plastic surgeon, claiming he used post-operative images without their permission and displayed them for all the world to see. James Moritz and his partner Doug Hill say their surgeon took advantage of them while they were at their most vulnerable, and were shocked to see photos (several which included their faces) splashed on fliers, ads and billboards months after their 2012 surgery.
According to the New York Post, Hill and Moritz have taken legal action against their surgeon, and are seeking $18 million in compensation. The suit was filed in the Manhattan Supreme Court, and accuses the Upper East Side surgeon of breaking his Hippocratic Oath, leaving his patients both distressed and humiliated.
Forty-seven-year-old Hill alleges that he found videos and photos in which his face and torso were visible on his surgeon’s Facebook page and Gotham Surgery website, including ones that showed “a distinctive tattoo on his lower abdomen.”
“These types of breaches in doctor-patient confidentiality have become more and more rampant in the digital age,” said Moritz and Hill’s attorney.
Patients who seek medical treatment, whether from a family care practitioner or cosmetic surgeon, must feel safe that their concerns, insecurities and health issues are kept confidential at all times.
